UGANDA: POLICE ENFORCEMENT OF NRM PARTY DISCIPLINE IS ILLEGAL

"Those who altered results will go to jail on forgery, fraud, subversion etc. and their forgeries will not stand. It is an exercise in futility for anybody to create a new reality on DR forms that is not in the villages. Anybody who participated in such transparent criminality commits fraud and the sentence for fraud is 3-5 years in prison. Therefore, the aggrieved candidates, get facts from a sample of villages from your village agents, who must speak truthfully otherwise they will also be charged with aiding and abetting a fraud as well as making false declarations, the Police will cross-check and criminal proceedings will be initiated. Minister Rukutana is in jail and will be prosecuted. They will be fully accountable with robust charges: assault, attempted murder, murder etc,” Those who altered results will go to jail on forgery, fraud, subversion etc. Rukutana was not given "police bond because, according to the police, the evidence is clear and they should go for trial. I hope the DPP will also oppose bail."
Museveni - whitewashing his fraudulent and sham party primaries exercise. 

His fake Electoral Commission Chairman Dr. Tanga Odoi also ordered the police to commence criminal proceedings against those he accused of perpetuating irregularities in Mbarara and Rwampara Districts. 
“I am handing over village registrars of cells of Karugangama, Biwunya, Nyamityobora Lower, Agip and Saveya to police and also Ms Atukwasa (contestant) should be investigated because all the excess votes added were in her favour. Annulling a result is criminal. I will call on police to come and arrest Richard Asiimwe because yesterday, they should have arrested him. That causes chaos in the district,” he said. The Rwizi Regional Police spokesperson Samson Kasasira said they have not yet received the case, but added that it will be handled accordingly once it reaches their office.

In Bushenyi district, the Police arrested the Kizinda Town Council NRM party registrar Evans Natwijuka for allegedly tampering with the voter's register. 

During the 2015 exercise to produce a new NRM part register, two party District Chairmen and three party District Registrars for Amolatar, Buikwe and Gulu's Pece Division we're arrested for alleged misconduct and misuse of registration materials. The Kyoga County M.P Hon. Okello Anthony was reported to Amolatar Police Station on accusations of ferrying ghost supporters from Kalaki in neighbouring Kaberamaido district. Obviously, no charges were brought against them by police since the alleged crimes we're not stipulated anywhere in the laws of Uganda. 

Elections in Uganda are governed by the National Constitution of 1995 and other legislation. Internal party elections are governed by their respective part constitutions, codes of conduct and guidelines as the case may be. The national police can not enforce internal party discipline. However, in the event of crimes that are stipulated in national legislation, the police has the mandate to handle. Threatening violence, assault, murder or attempted murder are crimes stipulated by law but inflating a party register, multiple voting and other irregularities in Internal party elections cannot be enforced by the national police. Are we about to see the police arresting a house wife or domestic worker who cooks badly for the family, not properly mopping the floor or not surrendering the balance of the money after buying a half kilogram of salt!!!! What about a church member who fails to honour his pledge of financial contribution towards the construction of a church!!!

Even where the stipulated crimes arise from internal party primaries, it is wrong for Museveni to assume the powers of the DPP and court to determine the charges, bond, bail and sentence of the accused. He should let the judicial process to take it's course. It is equally wrong for Museveni to deploy the police, prisons and army to supervise the internal party elections. It's more worse when he orders for the deployment of 15,000 (six brigades) armed personnel in the so-called hot spot districts of Sembabule and Ntungamo. It implies that in the general elections, he will seek for the intervention of UN, AU and EAC peace keeping force!!! He is just trying to divert attention from his role in the irregularities and violence that ensued after he undermined the mandate of his Electoral Commission on the election eve by allowing unregistered voters to take part.
