WHY THE ULS PRESIDENT MAY SOON PLAY HOST TO 'UNKNOWN PEOPLE'
CHANGE OF GUARDS - The President of Uganda Law Society (ULS), Simon Peter Kinobe is again up in arms threatening to institute criminal proceedings against Museveni's security agencies and in particular the Director General of Internal Security Organization (ISO), Col. Kaka Bagyenda over alleged kidnappings, torture and detention of people in illegal detention facilities.
Such illegal facilities dubbed Safe Houses are not new under the Museveni regime. The current uproar arises out of the recent kidnap and illegal detention of a city Lawyer, Patrick Mugisha by the usual unidentified gunmen. He was detained at the infamous ISO Safe House located in Kyengera for four days. During the nasty ordeal, Mugisha is said to have been coerced into signing an MOU over a land transaction.
While he was in captivity, Mugisha found there among other captives, another Lawyer, James Muliira who had been detained three days earlier. Mugisha's early release was prompted by a High Court order to government and security agencies to produce him in court. The threat by the ULS President to institute criminal proceedings against Col. Kaka is premised on S. 42 of the Security Organizations Act of 1987 that prohibits the agencies (ISO & ESO) from carrying out arrests, detention and confinement of people for whatever reasons.
However, despite the above legal provision, the issue of kidnapping, torture and detention of people in the so called Safe Houses by Museveni's security agencies is as old as the statute and the regime itself. The vice is now a norm and the desperate regime that is thriving on keeping the population in perpetual fear. The sad news is that these security organs are getting stronger than the legislature and judiciary. Recent times have witnessed security agencies repeatedly raiding both Parliament and the courts of law to influence or reverse decisions; not to mention out rightly ignoring judicial and legislative orders. Actually, the Kyengera Safe House is no longer a secret as it even releases on bail and allows some captives to be visited by family members - refer to the victim, Simpson Birungi of Movit.
There have been various attempts to institute criminal and civil proceedings against individuals and agencies responsible for kidnapping, torturing and illegally detaining Ugandans. The former Police chief, Gen. Kalekyezi was shielded by the DPP to block private prosecution proceedings against him over torture of citizens by the police. Some entities and individuals including ULS have in the past attempted to bring criminal proceedings against Col. Kaka as early as 2018 over similar changes including the raid on MTN. The proceedings could not take off and instead Col. Kaka has since doubled his rampage.
Therefore, if Counsel Kinobe and his ULS insist on pushing on with legal proceedings against ISO and Col. Kaka, Kinobe is most likely going to either visit the hospital or be visited by the usual 'unidentified people.'
